We collect several types of information from and about users of our Website, including information:

As part of the nature of our business, we use the information provided by you to accept donations and to extend scholarships and grants in furtherance of our educational and charitable purpose. This often entails collecting sensitive information about students that are potential scholarship and grant recipients. We use this information solely for the purposes of assessing needs and providing services.

The information we collect on or through our Website may include:

  • Information can include first and last name, E-mail address, date of birth, financial information including tax returns, current and past medical treatment, current and past cognitive therapies, and names of medical or educational professionals involved in current or past treatment/therapies.
  • Records and copies of your correspondence (including E-mail addresses), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.

  • Personal information will solely be used to determine scholarship eligibility and will not be used for any commercial purpose or sold to third parties.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

We are committed to protecting the security and integrity of personal information, and we use procedures and technology designed for this purpose.  For example:

  • We limit employee access to personal information to those who have a business reason to know this information.
  • We maintain policies and procedures covering the physical security of workplaces and records.
  • We use technological means (such as backup files, virus detection software, firewalls, and other computer software and hardware) to protect against unauthorized access or alterations to personal information.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We contract with service providers to maintain and manage information about our donors and our applicants and recipients in order to fulfill contractual obligations and to communicate with you in accordance with your wishes. We carefully choose service providers that we use to store and process your information including, but not limited to, Google (G Suite). We do not authorize any of these service providers to make any other use of your information.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

While we employ many different security techniques to protect such data from unauthorized access by users, inside and outside the Foundation, perfect security does not exist on the Internet.  As the security of information depends in part on the security of the device you use to communicate with us and the security you use to protect user usernames and passwords, please take appropriate measures to protect this information.  Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

Disclosure of Your Information

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.  The Foundation may share your personal information or information about your child with Lindamood-Bell Learning Processes (a California Corporation).  You have the right to revoke any given consent for these entities to share your information at any time by emailing privacy@thescfoundation.org.  Your preference as to whether the Foundation and Lindamood-Bell Learning Processes may share information about your child has no bearing on the status of your application or the likelihood of being accepted.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Foundation’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Foundation about our Website users is among the assets transferred.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. As a rule, we will obtain your consent prior to sending promotional materials.  If you no longer wish to receive promotional information from us, or if you do not want us to use your information to enhance your online experience, you may OPT OUT of receiving our promotional communications by simply following the Unsubscribe or Preference Center link at the bottom of our emails and updating your cookie settings.  We will maintain your information in our “do not contact” list to ensure that we can honor your request. Please note that it may take up to 30 days to process your opt out request, during which time you may continue to receive communications from the Foundation.

If selected for a scholarship, the Foundation may seek your authorization to take and share photos, pictures, and/or videos of your child, which may include your permission to use this material for promotional purposes.  You can update your consent at any time by E-mailing privacy@thescfoundation.org.

Our Website may contain links to other sites. We do not control third parties’ collection or use of your information or the privacy policies or practices of these websites. However, these third parties may provide you with ways to choose not to have your information collected or used.  You should review those policies before providing any personal information. The Foundation is not responsible for the content or practices of any linked websites, and we provide these links solely for the convenience and information of Website users.

Accessing and Correcting Your Information

You can review and change your personal information by logging into the Website and visiting your account profile page.

You may also send us an E-mail at privacy@thescfoundation.org to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our terms of use.

Storage of Your Information

Personal information will be retained as long as it is required for the purposes for which it was collected e.g. as necessary to provide the services requested. Once our contractual relationship with you comes to an end or in case of the service recipient, following the termination of the contractual relationship for which your personal information was processed, we will delete the personal information unless statutory retention requirements apply e.g. for taxation purposes or in order to fulfil regulatory requirements. We retain your contact details and interests in our services for a longer period of time if we are allowed to send you promotional communications. We also retain your personal information if needed to establish, exercise or defend a legal claim.

Reporting Requirements

In the unfortunate event we become aware of any unauthorized access or use of personal information stored by us as a result of actions taken by the Foundation or any outside party, we will report this to the appropriate authorities, as required by law. We have an incident response plan that is always followed and might result in the direct notification to any individual whose personal information is involved in the incident. The exact steps taken to report and notify of any such event are always guided by paid, third party, legal services. If you become aware of any unauthorized use or access of your personal information as a result of our data practices, please notify us immediately using any of the methods of communication identified in this policy.

Rights Applicable to California, European Union and UK Residents

California, European Union and UK residents may have further rights in addition to those mentioned above.  This Privacy Policy reflects our compliance with the General Data Protection Regulation (“GDPR”) of the European Union and state statutes including California’s “Shine the Light” law (Civil Code section 1798.83) and the California Consumer Privacy Act. 

Right of Access

You have the right to obtain from us confirmation as to whether or not personal information concerning you, or (for parents / guardians) the Service User, is being processed, and where that is the case, to request access to the personal information. The accessed information includes – among others – the purposes of the processing, the categories of personal information concerned, and the recipients or categories of recipients to whom the personal information have been or will be disclosed. You have the right to obtain a copy of the personal information undergoing processing. For further copies requested by you, we may charge a reasonable fee based on administrative costs

Right to Rectify and Complete Personal Information

You can request the rectification of inaccurate data and the completion of incomplete data. We will inform relevant third parties to whom we have transferred your data about the rectification and completion if we are legally obliged to do so.

Right to Erasure (Right to be Forgotten)

You have the right to obtain from us the erasure of personal information concerning you in limited circumstances where:

  • it is no longer needed for the purposes for which it was collected;
  • you have withdrawn your consent (where the data processing was based on consent);
  • following a successful right to object;
  • it has been processed unlawfully; or
  • the data has to be erased in order to comply with a legal obligation to which the Foundation is subject. We are not required to comply with your request to erase personal information if the processing of your personal information is necessary for:

1) compliance with a legal obligation; or

2) the establishment exercise or defense of legal claims.

Right to Restriction of Processing

You have the right to request restrictions to the processing of your personal information. In this case, the respective data will be marked and can only be processed by us for certain purposes. This right can only be exercised where:

  • the accuracy of your personal information is contested, to allow us to verify its accuracy;
  • the processing is unlawful, but you do not want the personal information erased;
  • it is no longer needed for the purposes for which it was collected, but you still need it to establish, exercise or defend legal claims; or you have exercised the right to object, and verification of overriding grounds is pending. We can continue to use your personal information following a request for restriction, where

Right to Object

If you are a resident or citizen of the EU or UK (as applicable), you can ask to obtain a copy of, or reference to, the safeguards under which your personal information is transferred outside the EU or the UK (as applicable). We may redact data transfer agreements to protect commercial terms.
